1. Introduction
Welcome to CourtPass. These Terms of Service ("Terms") govern your access to and use of the CourtPass website at www.mycourtpass.com (the "Website") and the CourtPass mobile application (the "App"), collectively referred to as the "Platform".
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
2. Definitions
- "CourtPass", "we", "us", or "our" refers to CourtPass Pty Ltd, the owner and operator of the Platform.
- "User", "you", or "your" means any person who accesses, browses, or uses the Platform.
- "Venue" or "Club" means any sports facility or organisation that offers court bookings or services through CourtPass.
- "Services" include court discovery, booking, player matching, event listings, and any other features offered through the Platform.
- "Content" means any information, data, text, images, video, or other materials displayed on the Platform.
3. Eligibility
You must be at least 16 years of age to use CourtPass. By using the Platform, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms.
If you are under 18, you confirm that you have obtained consent from a parent or guardian to use the Platform.
4. Account Registration
4.1 Account Creation
To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
4.2 Account Security
You must notify us immediately at hello@mycourtpass.com if you become aware of any unauthorised use of your account. We are not liable for any loss arising from unauthorised access to your account where you have failed to maintain the security of your credentials.
4.3 Account Accuracy
You agree to keep your account information up to date. We reserve the right to suspend or terminate accounts that contain false or misleading information.
5. Use of the Platform
5.1 Permitted Use
You may use the Platform for lawful purposes related to discovering, booking, and playing at sports courts. You agree to use the Platform in accordance with these Terms and all applicable laws.
5.2 Prohibited Conduct
You must not:
- Use the Platform for any unlawful purpose or in violation of any applicable law.
- Create false or fraudulent bookings.
- Provide false, inaccurate, or misleading information.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Interfere with or disrupt the Platform, servers, or networks connected to the Platform.
- Attempt to gain unauthorised access to any part of the Platform or any systems or networks connected to it.
- Use the Platform to harass, threaten, or inappropriately contact other users.
- Scrape, crawl, or use automated means to access or collect data from the Platform without our prior written consent.
- Upload or transmit viruses, malware, or any other malicious code.
- Use the Platform to send unsolicited communications (spam).
5.3 Community Standards
CourtPass promotes a respectful and inclusive sporting community. Users are expected to:
- Treat all players, venue staff, and other users with respect.
- Honour confirmed bookings and arrive on time.
- Follow the rules of the sport and the specific rules of each venue.
- Use appropriate language in all communications through the Platform.
- Report any unsafe conditions, inappropriate behaviour, or violations of these Terms.
We reserve the right to suspend or terminate the account of any user who violates these community standards.
6. Bookings and Reservations
6.1 Booking Process
CourtPass acts as a platform connecting users with sports venues. When you make a booking through CourtPass, you are entering into an agreement with the venue for the use of their facilities.
6.2 Pricing
Court prices are set by the venues and displayed on the Platform at the time of booking. Prices are shown in Australian Dollars (AUD) or New Zealand Dollars (NZD) depending on the venue location, and include GST where applicable.
6.3 Payment
Payment is processed at the time of booking through our secure third-party payment provider. By making a booking, you authorise us to charge the specified amount to your chosen payment method.
6.4 Cancellations and Refunds
Cancellation policies are set by individual venues and are displayed at the time of booking. Please review the cancellation policy before confirming your booking.
- Venue cancellation policies vary. Some venues offer free cancellation up to a certain time before the booking; others may be non-refundable.
- CourtPass cancellations: If CourtPass cancels a booking due to a platform error, you will receive a full refund.
- Venue cancellations: If a venue cancels your booking (e.g., due to maintenance or weather), you will receive a full refund.
Refunds are processed to the original payment method and may take 5-10 business days to appear.
7. Player Matching
7.1 Player Matching Features
CourtPass may offer features to help you find other players for matches. When you use these features, limited profile information (such as your name and skill level) may be visible to other users.
7.2 Disclaimer
CourtPass is not responsible for the conduct of other users you connect with through the Platform, whether before, during, or after a match. You participate in matches and activities at your own risk.
8. Intellectual Property
8.1 Our Intellectual Property
All content, features, and functionality on the Platform, including but not limited to text, graphics, logos, icons, images, audio, software, and design, are the exclusive property of CourtPass or its licensors and are protected by Australian and international copyright, trademark, and other intellectual property laws.
8.2 Limited Licence
We grant you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.
8.3 Restrictions
You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, or transmit any content from the Platform without our prior written consent, except for temporary caching by your browser or printing pages for personal use.
The CourtPass name, logo, and all related branding are trademarks of CourtPass Pty Ltd. You must not use these marks without our prior written permission.
9. Limitation of Liability
9.1 Platform Availability
We strive to keep the Platform available at all times, but we do not guarantee uninterrupted or error-free access. We may suspend or restrict access for maintenance, updates, or reasons beyond our control.
9.2 Venue Services
CourtPass is a platform that connects users with venues. We are not responsible for the quality, safety, or suitability of any venue, court, or service booked through the Platform. Any disputes regarding venue services should be directed to the venue in the first instance.
9.3 Limitation
To the maximum extent permitted by Australian Consumer Law, our total liability to you for any claim arising out of or relating to these Terms or your use of the Platform is limited to the amount you have paid to CourtPass in the 12 months preceding the claim.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or the New Zealand Consumer Guarantees Act 1993 that cannot be excluded, restricted, or modified by agreement.
10. Indemnification
You agree to indemnify and hold harmless CourtPass, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, available at www.mycourtpass.com/privacy. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
12. Third-Party Links and Content
The Platform may contain links to third-party websites, services, or content that are not owned or controlled by CourtPass. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. You access third-party content at your own risk.
13. Modifications to the Platform and Terms
13.1 Platform Changes
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform.
13.2 Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our Website and, where appropriate, by email. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
14. Termination
14.1 By You
You may close your account at any time by contacting us at hello@mycourtpass.com. Closing your account does not affect any existing bookings or outstanding payments.
14.2 By Us
We reserve the right to suspend or terminate your account at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if required by law. Upon termination, your right to use the Platform ceases immediately.
15. Dispute Resolution
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia.
15.2 Resolution Process
If a dispute arises, we encourage you to first contact us at hello@mycourtpass.com so we can attempt to resolve the matter informally. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through the courts of New South Wales, Australia.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CourtPass regarding your use of the Platform.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
16.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights under these Terms without restriction.
16.5 Force Majeure
We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet or telecommunications failures, or pandemic.
